Terms of Service

The agreement between OptiSight and the dealership groups that use it. For how we handle your data, see our Privacy overview.

Last updated: 2026-07-13

1. The Agreement

These Terms of Service (“Terms”) govern access to and use of the OptiSight platform, including the web application at app.optisight.io and related services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms on behalf of yourself and, if applicable, the dealership or dealer group you represent (“Customer”).

If your organization has a signed subscription agreement or master services agreement with OptiSight, that agreement controls where it conflicts with these Terms.

2. The Service

OptiSight provides analytics, reporting, compensation-plan, and operational tooling for automotive dealerships. We may improve or modify features over time; material changes that remove functionality your organization relies on will be communicated to account administrators in advance where practical. Release history is published on our changelog.

3. Accounts and Acceptable Use

  • Accounts are provisioned by your organization’s administrators and are for individual, named users. Keep credentials confidential; you are responsible for activity under your account.
  • Use the Service only for lawful business purposes related to your dealership operations.
  • Do not attempt to probe, disable, or circumvent security controls; access data belonging to another organization; or reverse engineer, scrape, or resell the Service.
  • We may suspend accounts that present a security risk or materially violate these Terms, and will notify the Customer’s administrators when we do.

4. Customer Data

As between the parties, the Customer owns the business data it uploads or generates in the Service. OptiSight processes that data only to provide and improve the Service, as described in our Privacy overview. We do not sell Customer data or use it to train AI models. On confirmed termination, data is deleted within 30 days, except backups that expire on standard rolling windows.

5. Fees and Term

Subscription fees, billing cadence, and term are set in the Customer’s order form or subscription agreement. Either party may terminate as provided there. We may suspend the Service for accounts with undisputed overdue fees after reasonable notice.

6. Intellectual Property

OptiSight retains all rights in the Service, including software, design, and documentation. The Customer receives a limited, non-exclusive, non-transferable right to use the Service during the subscription term. Feedback you provide may be used to improve the product without obligation.

7. Availability and Support

We work to keep the Service available and performant, and we publish maintenance and incident updates to account administrators. Support is available as described on our Support page. The Service is provided “as is” without warranties of any kind except as stated in a signed agreement.

8. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and OptiSight’s aggregate liability arising out of the Service is limited to the fees paid by the Customer in the twelve months preceding the claim. Nothing in these Terms limits liability for willful misconduct or amounts that cannot be limited by law.

9. Changes to These Terms

We’ll post material updates on this page and update the “last updated” date above. Significant changes will be communicated by email to account administrators before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
